Terms & Conditions

1. Definitions
In these definitions the Supplier is referred to as “the Seller” and the person, firm or company placing the order is referred to as “the Buyer” or “the Customer”, “the Goods” means any goods ordered by the Buyer from the Seller.

2. Consumer Protection
Nothing in these Conditions shall affect the statutory rights of a Buyer who in relation to the Seller “deals as a consumer” as defined in Section 12 of the Unfair Contracts Terms Act 1977 or any amendment or modification thereof.

3. General
3.1. It is a condition of this contract that the Buyer must read all instructions provided and have or obtain the necessary electrical and/or mechanical skills necessary before undertaking installation of any Goods provided by the Seller.
3.2.  The Seller shall not be liable to repair Goods damaged due to incorrect installation.
3.3. The Buyer is responsible for the inspection of any Goods provided by the Seller immediately on collection or delivery and shall notify the Seller of any alleged faults or omissions in writing within 7 days of the receipt of the Goods supplied

4. Prices
All prices quoted by the Seller are exclusive of Value Added Tax and will be added at the appropriate rate at the time of invoicing.

5. Payment
5.1.  Save where the Seller has granted a credit account to the Buyer, Goods will be supplied only on a full payment with order basis.
5.2.  Application for a credit account to be written, indicating approx monthly credit requirement and accompanied by two trade and bankers reference.
5.3.  Payment of account is due within 28 days of the invoice date. The Seller reserves the right to charge interest on the balance monthly for the term any debt is overdue at the National Westminster Bank plc current base rate plus 4%.
5.4.  Where the Seller delivers part of an order, the Seller shall nevertheless be entitled to payment for that part.
5.5.  Where any cheque rendered in payment is refused or has to be re-presented, the Seller will charge £20.00 + an administration charge to the Buyer.
5.6.  Prices quoted for export (outside the UK) are ex-works. Payment to be made by Visa.
5.7.  Where the Seller accepts an order from the Buyer for Goods which are not listed in the current price list, the Buyer shall make payment in full at the time of placing the order. Save where the Seller fails to provide the Goods so ordered within a reasonable time after the named date of delivery, the Buyer shall not for any reason whatsoever be entitled to return for refund the Goods so ordered.

6. Delivery
6.1.  No carriage charges are applied when electronic security Goods minimum order value £350 are delivered by our vehicles. In all other cases, carriage and packing charges are extra. Despatch is via carrier or surface post unless otherwise stated.
6.2.  Each delivery or part delivery of an order by the Seller shall be treated as a separate contract and failure on the part of the Seller to make any delivery or part delivery shall not affect or vitiate this contract with regard to other deliveries.
6.3 Carriage costs for delivery of safes are quoted on our Lock and Safe website.

7. Cancellation and Returns
7.1 For a short period (7 days) from day after receipt of the Goods you will have the right to cancel, the Goods should be returned in new condition at the customer’s expense. We will provide a full refund including P&P within 30 days of written notification of cancellation.
7.2 For returns made outside the cancellation period any refund will be minus P&P costs and the Goods will be returned at the cost of the Customer. It is the Customer’s responsibility to return all Goods after cancelling an order.

8. Guarantee
The Seller will at its option replace or repair Goods which are defective by reason of faulty material or workmanship provided that the Buyer has returned the Goods within 12 months of the date of purchase. Goods so returned must be accompanied by a copy of the original invoice and at the cost of the Buyer.

9. Risk
From the time of delivery the Goods shall be at the risk of the Buyer whereupon the Buyer shall insure the Goods for their full reinstatements value for the benefit of the Seller. The Buyer shall:
9.1. keep the Goods separate and identifiable from all other Goods in its possession.
9.2. permit the Seller access to such Goods and permit the supplier to re-possess same should the Seller so demand.

10. Ownership
10.1.  All Goods delivered by the Seller to or to the order of the Buyer shall remain the property of the Seller until all sums due to the Seller from the Buyer whether or not in respect of such Goods have been paid in full.
10.2. Upon the occurrence of any of the events specified in clause 13 hereof the Seller shall be entitled to immediate possession of all Goods in the custody or under the control of the Buyer. The Buyer shall hold such unused or unmixed Goods at the disposal of the Seller who shall be entitled to enter upon any land or premises of the Buyer or where the Goods are situated for the purpose of recovering the same.

11. Advice
11.1. The Seller shall be under no liability whatsoever in respect of any advice it has given or views it has expressed to a Buyer whether or not such advice is given or such views expressed at the Buyer’s request.
11.2. The Buyer acknowledges that he/she was not induced to contract with the Seller as a result of any oral representation or whatever nature made to him/her by any servant or agent of the Seller.

12. Exclusion of Liability
In no circumstances will the Supplier or its employees be liable for any loss or damage of any kind whatsoever (other than death or personal injury resulting from the Supplier’s negligence), whether consequential or otherwise caused directly or indirectly by any negligence on the part of the Supplier or any of its employees in connection with or arising out of the supply of Goods or in connection with any statement made (or advice not given) by or on behalf of the Supplier.

13. Default of the Buyer
The Buyer shall immediately notify the Supplier and set aside the Supplier’s Goods if any for collection by the Supplier in the event that the Buyer
a) has had a bankruptcy order made against it, or
b) has made an arrangement or composition with its creditors, or
c) otherwise taken the benefit of any Act for the time being in force for the relief of insolvent debtors or
d) has suffered or allowed any execution whether legal or equitable to be levied on his property or obtained against him, or
e) (being a body corporate) has had convened a meeting of creditors (whether formal or informal), or
f) has entered into liquidation (whether voluntary or informal) except a solvent voluntary liquidation for the purpose only of reconstruction or amalgamation , or
g) has a receiver manager administrator or administrative receiver appointed of its undertaking or any part thereof
or a resolution has been passed or a petition presented to any Court for the winding-up of the Buyer of any proceedings have been commenced relating to the insolvency or possible insolvency of the Buyer.

14. Liability in all cases is limited to the purchase price of Goods supplied only.

15. In any case of litigation English Law shall always be deemed to apply.
